{"id":7934,"date":"2016-12-09T19:07:49","date_gmt":"2016-12-10T00:07:49","guid":{"rendered":"https:\/\/english.cpnn-world.org\/?p=7934"},"modified":"2016-12-09T19:10:29","modified_gmt":"2016-12-10T00:10:29","slug":"200-legal-scholars-back-right-to-boycott-israel","status":"publish","type":"post","link":"https:\/\/english.cpnn-world.org\/?p=7934","title":{"rendered":"200 legal scholars back right to boycott Israel"},"content":{"rendered":"<div style=\"float: left; width: 46%;\">\n<p>.DISARMAMENT &#038; SECURITY. .<\/p>\n<p>An article by Ali Abunimah from the <a href=\"https:\/\/electronicintifada.net\/blogs\/ali-abunimah\/200-legal-scholars-back-right-boycott-israel\">Electronic Intifada<\/a><\/p>\n<p>More than 200 European legal scholars have signed a statement affirming that the boycott, divestment and sanctions (BDS) movement for Palestinian freedom, justice and equality represents \u201ca lawful exercise of freedom of expression.\u201d<\/p>\n<p>The Palestinian BDS National Committee (BNC) is welcoming the statement as \u201ca major blow to Israel\u2019s repressive legal war\u201d against the movement.<\/p>\n<p><center><a href=\"https:\/\/english.cpnn-world.org\/wp-content\/uploads\/2016\/12\/bds.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/english.cpnn-world.org\/wp-content\/uploads\/2016\/12\/bds-300x197.jpg\" alt=\"\" width=\"300\" height=\"197\" class=\"alignnone size-medium wp-image-7935\" srcset=\"https:\/\/english.cpnn-world.org\/wp-content\/uploads\/2016\/12\/bds-300x197.jpg 300w, https:\/\/english.cpnn-world.org\/wp-content\/uploads\/2016\/12\/bds.jpg 724w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/center><\/p>\n<p>\u201cThis momentous statement by European jurists not only vindicates BDS human rights defenders who have insisted that BDS is protected free speech,\u201d said the BNC\u2019s Europe campaigns coordinator Riya Hassan. \u201cIt will undoubtedly add a crucial layer of legal protection for European BDS networks and citizens in their efforts to end European complicity in Israel\u2019s regime of oppression, especially in military trade and research, banking and corporate involvement in Israel\u2019s violations of international law.\u201d<\/p>\n<p>The BNC notes that the signatories include world-renowned legal figures, including South African jurist John Dugard, who serves as a judge at the International Court of Justice in The Hague; Jos\u00e9 Antonio Mart\u00edn Pall\u00edn, an emeritus justice of Spain\u2019s supreme court; British human rights lawyer Michael Mansfield; Lauri Hannikainen, member of the European Commission against Racism and Intolerance and G\u00e9raud de la Pradelle, who led the civic inquiry into the involvement of France in the 1994 Rwanda genocide.<\/p>\n<p>While the jurists do not take a position for or against BDS, they say that \u201cstates that outlaw BDS are undermining this basic human right and threatening the credibility of human rights by exempting a particular state from the advocacy of peaceful measures designed to achieve its compliance with international law.\u201d<\/p>\n<p>(Article continued in right column)<\/p>\n<\/div>\n<div style=\"float: right; width: 46%;\">Question related to this article:<\/div>\n<div style=\"float: right; width: 46%;\"><\/div>\n<div style=\"float: right; width: 46%;\">\n<p align=\"justify\">\n<p><em><strong><a href=\"https:\/\/english.cpnn-world.org\/?p=7690\">Presenting the Palestinian side of the Middle East, Is it important for a culture of peace?<\/a><\/strong><\/em><\/p>\n<p>(Article continued from left column)<\/p>\n<p>They point to France, the United Kingdom, Canada and various US states, where legislatures and executives \u201chave adopted laws and taken executive action to suppress, outlaw and in some instances, criminalize the advocacy of BDS.\u201d<\/p>\n<p>By contrast, Sweden, Ireland, the Netherlands, the European Union and even the US State Department have all recently affirmed that advocating for BDS is a protected right.<\/p>\n<p>\u201cStates and organizations that view BDS as a lawful exercise of freedom of expression are correct,\u201d the legal scholars say. \u201cWhether one approves of the aims or methods of BDS is not the issue. The issue is whether in order to protect Israel an exception is to be made to the freedom of expression that occupies a central and pivotal place among fundamental human rights.\u201d<\/p>\n<p>\u201cThe right of citizens to advocate for BDS is part and parcel of the fundamental freedoms protected by the International Convention on Civil and Political Rights,\u201d signatory Robert Kolb, a professor of international law at the University of Geneva and a former legal adviser to the International Committee of the Red Cross and the Swiss foreign ministry, said in a statement from the BNC.<\/p>\n<p>\u201cNo government ever attempted to outlaw or criminalize the anti-apartheid movement for advocating boycott, disinvestment or sanctions to compel South Africa to abandon its racist policies,\u201d Dugard said. \u201cBDS should be seen as a similar movement and treated accordingly.\u201d<\/p>\n<p>The legal scholars join hundreds of European human rights organizations and civil society groups that have called on governments to end repression of Palestine solidarity activism.<\/p>\n<p>Speaking on behalf of the BNC, Ingrid Jaradat welcomed the statement as \u201ca defining moment in the struggle against Israel\u2019s patently repressive legal war on the BDS movement for Palestinian rights.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>.DISARMAMENT &#038; SECURITY. .
